Terms of Service

These Terms of Service govern access to Radio Galati Media Network, including advertiser accounts, campaign booking requests, payments, uploaded advertising materials, and related services.

2. Acceptance of these Terms

By visiting the website, creating an account, requesting a campaign, uploading materials, approving a booking, or paying for a service, you agree to these Terms and to our Privacy Policy.

If you use the service on behalf of a company, agency, association, venue, event organiser, or other organisation, you confirm that you are authorised to bind that organisation and to submit advertising materials on its behalf.

3. Eligibility and account registration

Advertiser accounts are intended for business users, agencies, event organisers, and authorised representatives who are at least 18 years old and legally able to enter into a contract.

During registration, you must provide accurate information, keep it up to date, protect your login credentials, and notify us immediately if you suspect unauthorised access. We may refuse, suspend, or close accounts that provide false information, create risk, misuse the service, or violate these Terms.

Authentication may be handled by Auth0 or a similar secure identity provider. You must not attempt to bypass login, security, payment, or approval flows.

4. Advertising booking flow

The portal allows you to request advertising services such as radio spots, presenter mentions, sponsored social posts, short videos, logo placements, event promotion, giveaways, and campaign bundles. A submitted request is not automatically accepted and does not guarantee publication, airtime, dates, reach, performance, or exclusivity.

A campaign becomes binding only when we confirm the scope, price, dates, deliverables, review status, and payment or invoicing requirements in writing or through the portal. We may request edits, substantiation, additional details, proof of rights, or compliance information before accepting a campaign.

5. Advertiser responsibilities

You are responsible for all information, claims, offers, prices, legal notices, images, audio, video, logos, links, files, and instructions you submit. You confirm that your campaign materials:

  • are accurate, lawful, and not misleading;
  • do not infringe copyright, trademarks, privacy, publicity, image, music, voice, performer, or other third-party rights;
  • include all required authorisations, licences, clearances, disclaimers, terms, eligibility rules, and substantiation for claims;
  • comply with applicable advertising, consumer protection, unfair competition, data protection, intellectual property, broadcasting, platform, prize, promotion, and sector-specific rules;
  • do not contain malware, tracking code, hidden pixels, illegal data collection, or unauthorised profiling technology;
  • do not target children or vulnerable groups in a prohibited or inappropriate way.

6. Restricted and prohibited advertising

We may reject, remove, pause, or require changes to any advertisement at our discretion, including materials that are illegal, unsafe, deceptive, offensive, discriminatory, exploitative, technically unsuitable, inconsistent with station values, or likely to create legal, editorial, brand safety, or reputational risk.

Campaigns involving regulated or sensitive subjects โ€” including alcohol, tobacco or nicotine, gambling, financial products, medical or health claims, political or electoral content, employment, housing, credit, age-restricted products, contests, prizes, charities, public interest claims, or similar categories โ€” may require additional review and may be refused even after submission.

7. Creative production and approvals

If we help produce audio, video, copy, visuals, presenter reads, or social content, the production remains subject to your review and approval before publication unless we agree otherwise. You must check names, prices, dates, legal terms, claims, pronunciation, offers, eligibility, contact details, and all factual information.

Reasonable changes may be included as part of the booking when agreed. Major changes, urgent changes, missed deadlines, new concepts, new recordings, or changes after approval may require additional fees or may affect publication dates.

8. Licence to use campaign materials

You grant us and our station, production, hosting, publishing, and platform partners a non-exclusive, worldwide, royalty-free licence to store, copy, adapt, edit, produce, broadcast, publish, distribute, display, and otherwise use your submitted materials as needed to review, produce, schedule, publish, report on, and archive the campaign.

This licence lasts for as long as needed to perform the booking, keep campaign evidence, comply with law, handle disputes, and maintain business records. You keep ownership of your underlying materials unless otherwise agreed in writing.

9. Payments, invoicing, and taxes

Prices, payment deadlines, included deliverables, taxes, VAT, invoice details, and payment method requirements will be shown in the portal, order confirmation, invoice, or written proposal. Unless otherwise stated, prices do not include taxes that must be added under applicable law.

Payments may be processed by Stripe. You must provide accurate billing and payment information and must be authorised to use the selected payment method. Stripe may handle payment card data, fraud checks, refunds, disputes, chargebacks, and related payment records.

We may pause, refuse, or cancel campaign delivery if payment is not authorised, is reversed, is disputed, or is overdue.

10. Cancellation, rescheduling, and refunds

Cancellation and rescheduling depend on campaign type, production status, publication dates, reserved inventory, and third-party platform requirements. Once work has started, materials have been produced, inventory has been reserved, or content has been published, fees may be non-refundable in whole or in part.

If we cancel a campaign because it violates these Terms, legal requirements, payment requirements, or editorial standards, we may charge for work already performed and for non-cancellable commitments. Statutory rights that cannot be excluded remain unaffected.

11. Availability and performance

We aim to keep the website and services available, but we do not guarantee uninterrupted access, error-free operation, or compatibility with every device, browser, platform, or third-party service.

Reach, impressions, listeners, followers, engagement, enquiries, conversions, sales, or other campaign outcomes are estimates or historical indicators only unless expressly guaranteed in a signed written agreement. We are not responsible for platform algorithm changes, outages, moderation decisions, stream interruptions, force majeure events, or user behaviour outside our control.

12. Intellectual property

The website, design, text, logos, graphics, audio elements, software, layouts, and other materials are owned by us or our licensors unless stated otherwise. You may not copy, scrape, reverse engineer, misuse, or redistribute them except as allowed by law or with written permission.

13. Acceptable use

You must not misuse the website or services. This includes attempting unauthorised access, interfering with security, uploading malicious files, scraping at unreasonable scale, impersonating others, submitting false information, violating laws, or using the service in a way that harms us, users, stations, advertisers, platforms, or third parties.

14. Suspension and termination

We may suspend or terminate access to the website, accounts, bookings, or services if we reasonably believe there has been a violation of these Terms, misuse, non-payment, legal risk, security risk, false information, or conduct that may harm the service or third parties.

15. Liability

Nothing in these Terms excludes liability that cannot be excluded under applicable law. To the fullest extent permitted by law, we are not liable for indirect loss, lost profits, lost revenue, lost opportunity, loss of data, reputational harm, platform decisions, third-party outages, or consequences caused by inaccurate materials submitted by you.

You agree to indemnify and hold us harmless from claims, damages, fines, costs, and expenses arising from your submitted materials, your campaign claims, your breach of these Terms, your violation of law, or your infringement of third-party rights.

16. Changes to the service or these Terms

We may update these Terms when our services, booking flows, providers, pricing structure, or legal requirements change. The latest version will be available on this page. Material changes may be communicated through the website, account portal, or email where appropriate.

17. Governing law and disputes

These Terms are governed by the laws applicable at the operator's place of establishment, unless mandatory consumer or data protection rules provide otherwise. Disputes should first be raised with us at office@radiogalati.ro so we can try to resolve the matter directly.
